2. Scope of Application

These Terms of Service (TOS) apply to all contracts you conclude with ColorLighthouse through our online shop.

3. Subject Matter

ColorLighthouse offers downloadable digital products, including LUTs, overlays, and other digital assets for filmmakers.

4. Contract Conclusion

A contract is formed through your order and its acceptance by ColorLighthouse. Acceptance is confirmed by an automated email containing a download link after successful payment.

5. Right of Withdrawal

Consumers (any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business, or profession) generally have a statutory right of withdrawal.

Please note:

According to German law, there is no right of withdrawal for the supply of digital content that is not supplied on a physical medium, if the supply has begun with your express consent before the expiry of the withdrawal period and you confirmed that you are aware that you lose your right of withdrawal upon commencement of the contract performance after the withdrawal period.

Therefore, please carefully consider whether you can waive your right of withdrawal before placing an order.

6. Prices and Payment

Prices listed on product pages are in Euros (€) and include statutory value-added tax (VAT).

7. Delivery

After successful payment, you will receive an email with a download link for the purchased digital products.

8. Retention of Title

The goods remain the property of ColorLighthouse until full payment is received.

9. Rights of Use

Digital products purchased from ColorLighthouse may only be used for your own non-commercial purposes. Sharing with third parties is prohibited.

10. Warranty

ColorLighthouse warrants that the download files are free from viruses and other malicious software.

Furthermore, the statutory warranty rights apply.

11. Liability

ColorLighthouse shall only be liable for damages demonstrably caused by intent, gross negligence, or the breach of essential contractual obligations by ColorLighthouse. Liability for slight negligence is excluded.

12. Dispute Resolution

However, we are not obligated to participate in an out-of-court dispute resolution procedure.

13. Final Provisions

Contracts between you and ColorLighthouse shall be governed exclusively by German law.

Should any provision of these TOS be or become invalid, the validity of the remaining provisions shall not be affected.
